Sale of City Property – G.S. 160A-269
An offer of $5,000 has been submitted for the purchase of certain property owned by the City of Graham, more particularly described as follows:
All that certain tract or parcel of land lying and existing in the City of Graham, Graham Township, Alamance County, North Carolina, bounded by the lands of West Elm Street, the right of way for Graham Drive, the lands of Walt C. Zamora, and the Alamance Municipal ABC Board, and being more particularly described as follows:
BEGINNING AT an existing iron stake in the corner of the southern right of way for West Elm Street and the lands of Walt C. Zamora, thence North 43 deg. 19 min. 59 sec. West 60.05 feet to a new iron pipe set in the corner of the right of way for Graham Drive and the right of way for W. Elm Street; thence South 56 deg. 18 min. 53 sec. West along a curve whose length is 105.19 feet, radius is 417.12 feet, and chord of 104.91 feet, to new iron pipe set in the new line of the southern right of way for Graham Drive; thence South 32 deg. 24 min. 16 sec. East 21. 25 feet to a new iron pipe in the new line of the southern right of way for Graham Drive; thence South 66 deg. 37 min. 11 sec. West 83.31 feet to a new iron pipe in the new line of the southern right of way for Graham Drive, a corner with the lands of the Alamance Municipal ABC Board; thence along the line with the Alamance Municipal ABC Board, South 41 deg. 57 min. 53 sec. East 39.57 feet to an existing iron stake, a corner with Walt C. Zamora and Alamance Municipal ABC Board; thence along the line with Walt C. Zamora, North 60 deg. 24 min. 09 sec. East along a curve for a distance of 193.52 feet, whose radius is 477.46 feet and chord of 192.20 feet to the point and place of the BEGINNING, containing 0.23 acres, more or less, as shown by a survey performed by Carolina Cornerstone, RLS # F-0975, dated June 25, 2018, to which map and plat reference is made for a more accurate description.
The conditions for this offer are as follows:
- Upset Offer to Purchase must have the following items specifically set out:
- Acceptance of Special Limited Warranty Deed.
- Accurate Survey leaving 15 feet along the southern boundary of Graham Drive, between West Elm Street and the rear lot line.
- Rear Lot line be configured to protect the riparian buffer of the wet weather stream in rear of lot.
- Erection of Fence by Purchaser 1 foot inside of property line along Graham Drive.
- Neither Purchaser or Possessor of property shall park outside of fence line along Graham Drive.
- Recognition that the lot is or will be zoned B-2, General Business – and that no junk cars shall remain outdoors upon the lot for any purpose.
- Any improvement of the lot shall require an appropriate building permit and inspection by the City.
Persons wishing to upset the offer that has been received shall submit a sealed bid with their offer to the office of the City Clerk, City Hall, 210 South Main Street, Graham, North Carolina 27253, by 5:00 p.m., July 25, 2018. At that time the city clerk shall open the bids, if any, and the highest qualifying bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.
A qualifying higher bid is one that raises the existing offer to an amount not less than $5,500.00, and must contain all of the conditions approved in the resolution of acceptance by the City Council.
A qualifying higher bid must be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier’s check, or certified check. The city will return the deposit on any bid not accepted, and will return the deposit on an offer subject to upset if a qualifying higher bid is received. The city will return the deposit of the final high bidder at closing. Failure to close the transaction by the final high bidder will forfeit the bid deposit.
The buyer must pay cash at closing.
The City Council must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed. The city reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject at any time all bids.
